Reference to “you”, “your” or “customer” is a reference to the user of our Services.

Reference to the “Services”, is a reference to the website namely viavii.com and the ViaVii mobile application that we operate.

Reference to “Policy” is a reference to the terms and conditions of our Privacy Policy provided herein.

Viavii Corporation has prepared this Privacy Policy to inform you of its policy and practices with regard to collecting, using, and disclosing your personal data, provided to us through your use of our Services.

Viavii Corporation protects the privacy of its internet users by complying with applicable regulations in force.

Unless otherwise defined in this Policy, the terms used herein have the same meanings as in our Terms and Conditions.

When you decide to use our Services, you hereby agree to Viavii Corporation collecting, using, and disclosing your personal data, including your personal and financial information, under the terms and conditions set out in this Policy. If you do not accept the terms of this Policy, or any amendment made hereto, we kindly ask that you leave or refrain from using our Services.

Your personal data is collected either with your explicit consent or is necessary for the execution of your orders (performance of a contract).

Your Personal Data is therefore collected in order to:

  • Process your questions and requests for information;

  • Enable you to set up a personal account at the Services, and to book or sell experiences;

  • Ensure the security of online transactions, prevent fraud and payment incidents;

  • Manage and optimize customer relations;

Should you fail to complete these mandatory fields, Viavii Corporation will not be able to respond to your requests and/or provide you with the products and services requested. Providing the other information is optional, however, this enables us to get to know you better and improve our communication and services to you.

Personal Data

While using our Services, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (hereinafter referred to as "Personal Data"). Personally, identifiable information may include, but is not limited to:

Payment Information

To use certain features of our Services (such as booking or selling experiences), you may be required to provide certain financial information (like your bank account or credit card information) in order to facilitate the processing of payments. All credit/debit card details and personally identifiable information will NOT be stored, sold, shared, rented, or leased to any third parties.

Usage Data

We may also collect information that your browser sends whenever you visit our Services or when you access the Services by or through a mobile device (hereinafter referred to as "Usage Data").

This Usage Data may include information such as your computer's “Internet Protocol” address (e.g. IP address), browser type, browser version, and the pages of our Services that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access the Services with a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We use cookies and similar tracking technologies to track the activity on our Services and hold certain information.

If you are located outside the Hashemite Kingdom of Jordan and choose to provide information to us, please note that we transfer the data, including Personal Data, to Hashemite Kingdom of Jordan and process it there.

Your consent to this Policy followed by your submission of such information represents your agreement to the transfer of your Personal Data and/or any other data provided to us by you.

Viavii Corporation will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Viavii Corporation may disclose your Personal Data in the good faith belief that such action is necessary to:

  • To protect and defend the rights or property of Viavii Corporation.

  • To protect the personal safety of users of the Services or the public.

  • With our trusted services providers who work on our behalf, do not have an independent use of the information we disclose to them and have agreed to adhere to the rules set forth in this Policy.

  • If Viavii Corporation is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Services of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

With Your Consent

Where you have provided consent, we share your information, including Personal Data, as described at the time of consent, such as when you authorize a third-party application or website to access your personal account at the Services and/or when you participate in promotional activities conducted by our partners and/or third parties.

Profiles and Listings

The ViaVii Platform lets you publish information, including personal information that is visible to the general public. For example:

  • Parts of your public profile page, such as your first name, your description, and the city, are publicly visible to others. Users have the right to keep their profile private and the decision to accept or reject friend requests.

  • “Experiences” are publicly visible if the user has not chosen to make it private, and include information such as the location (neighborhood and city) or precise location (where you have provided your consent), “Experiences” description, purchasing experiences, your public profile photo, and any additional information you choose to share.

  • The Services include a chat and photo aggregator linked to each experience that will be public if the sharing settings are not private. Users and service providers have the option to create private experiences and/or public.

ViaVii Platform may display parts of (e.g., your experiences) on sites operated by Viavii Corporation business partners, using technologies such as widgets or APIs. If your experiences are displayed on a partner’s site, information from your public profile page may also be displayed.

Information you share publicly on the Services may be indexed through third party search engines. In some cases, you may opt-out of this feature in your “Account settings”. If you change your settings or your public-facing content, these search engines may not update their databases. We do not control the practices of third party search engines, and they may use caches containing your outdated information.

 

Security of Data

Viavii Corporation has implemented appropriate technical and organizational measures in order to ensure the confidentiality and security of your Personal Data.

Viavii Corporation employees, who, due to their function, may have access to your Personal Data, are bound by strict non-disclosure obligations.

Kindly note that no internet data transfer is 100% secure and that all of the information provided online runs the risk of being intercepted and used by parties other than the intended recipient.

 

Service Providers

We may employ third party companies and individuals to facilitate our Services (hereinafter referred to as "Service Providers"), to provide the Service on our behalf, to perform Services related matters, or to assist us in analyzing how our Services are used.

No spam or spoof emails

We do not tolerate spam. To report Services related spam or spoof emails, please forward the email to [email protected]. You may not use our communication tools to send spam or otherwise send content that would violate our terms. We automatically scan and may manually filter messages to check for spam, viruses, phishing attacks, and other malicious activity or illegal or prohibited content.

Changes to This Privacy Policy

The Services Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards. Therefore the customers are encouraged to frequently visit these sections in order to be updated about the changes in the Services. Modifications will be effective on the day they are posted.

We will notify you of any changes by posting the new Policy on this page. We will let you know via email and/or a prominent notice on our Services, prior to the change becoming effective and update the "effective date" at the top of this Policy.

Account Deactivation

I want to deactivate my account, what do I need to do?

You can deactivate your account yourself at any time.

When you deactivate your account, any current reservations you have as a host or a guest will be deemed automatically canceled by you and the relevant cancellation policy applicable to the reservation will apply.

Is deactivation the same thing as a deletion request?

No. They are two different things. When you choose to deactivate your account, this allows you to reactivate your account if you so wish at a later date.

You can request the permanent deletion of your personal data and closure of your Services account at any point by submitting a data deletion request as outlined below under “Account Deletion”.

Account Deletion

I would like to delete or erase my account, what do I need to do?

You can submit a deletion request (or ask us to erase your personal information) at any time in accordance with our “Terms of Service” and Privacy Policy. Once your request is processed, your personal information will be permanently deleted (except for certain information that we are legally required and/or permitted to retain by law and your account will be permanently closed. This means that we will no longer be able to provide you with our services and if you decide to use our Services again in the future, you will need to set up a new account.

You may exercise your rights to have your Personal Data deleted by sending us an email. Please note that we may ask you to verify your identity before taking further action on your request.

Object to Processing

I want to object to the Services processing of some of my Personal Data for certain specific purposes, what do I do?

If allowed under the laws of the jurisdiction where you reside, you may request from us to refrain from processing your personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing, we will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing, or such processing is required for the establishment, exercise, or defense of legal claims.

Data Privacy Conditions:

"Data Protection Law" means any and all applicable laws and/or regulations relating to privacy and/or data protection in relation to the processing of the Personal Data, including any amendments and/or supplements to and/or replacements of such laws and/or regulations, including without limitation and as applicable: (i) the EU Directive on Data Protection (95/46/EC) and the EU Directive on Privacy and Electronic Communications (2002/58/EC); (ii) any national laws implementing such directives; (iii) the GDPR; and (iv) any Equivalent Law (as defined below). It is understood and agreed that the terms of this Policy shall supersede on all aforesaid laws; therefore, the customer cedes any rights granted to the customer pursuant to such laws related to privacy and non-disclosure of any information and/or data related to the customer whatsoever which could be disclosed and/or made by Viavii Corporation or any of its affiliates or subsidiaries and the customer relieves Viavii Corporation and its affiliates and subsidiaries from any liability whatsoever for such events.

“Equivalent Law” means the laws and/or regulations of any country outside the EEA that are intended to provide equivalent protections for Personal Data (or the nearest equivalent term under applicable data protection law and/or regulation) of Data Subjects as the GDPR (as defined below), including without limitation, the data protection laws of Jersey, Macau, Morocco, Switzerland, and the United Kingdom;

“GDPR” means the General Data Protection Regulation (EU) 2016/679 and any laws and/or regulations implementing or made pursuant to such regulation;

Governing Law - Disputes

These Terms and every transaction in relation to the subject matter herein shall be governed by and interpreted in accordance with the relevant applicable federal laws and jurisdiction of The State of Delaware - the United States of America and the Hashemite Kingdom of Jordan, in case of conflict the latter shall prevail. Nevertheless, we are solely entitled to seek legal actions and rely on any applicable law where you have a residence and/or own any assets therein and/or of your nationality
